Sonye — Terms of Service

These Terms of Service ("Terms") govern your use of Sonye, a manually curated, recurring pickleball game-slot service available at sonye.app (the "Service"). Sonye ("Sonye," "we," "us," or "our") is operated by an individual based in Texas, United States.

Please read these Terms carefully — they include a release of liability (Section 7) and an arbitration agreement and class-action waiver (Section 12) that affect your legal rights. By using Sonye, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility — you must be 18 or older

Sonye is for adults only. You must be at least 18 years old to create an account and to use the Service, including our text-message program. By using Sonye, you confirm that you are 18 or older. Sonye is not intended for, and may not be used by, anyone under 18.

2. The Service

Sonye lets an owner publish curated pickleball game slots at a small set of public courts in the Dallas area. You can join a slot or leave it. To keep games well-attended, you may hold at most one game per calendar day. When a slot fills, the group is set, and the players meet at the listed court to play. Once you join, you can coordinate with the other joined players on the game's lobby wall. Sonye is currently free and processes no payments.

Sonye curates and lists time slots only. We do not run, referee, supervise, or staff the games themselves, and we do not own or control the courts where games take place.

3. Your account

You sign in to Sonye using your mobile phone number and a one-time passcode we text to you. You are responsible for the phone number and device associated with your account and for activity that happens through your account. Keep your phone secure.

4. Text messages (SMS)

By providing your phone number and continuing, you agree to receive recurring automated text messages from Sonye. This is the same consent shown on our sign-in screen.

  • What we send. Sonye sends only two kinds of automated text message: (1) one-time login passcodes when you sign in, and (2) post-game attendance confirmations with a simple yes/no link after a game. We do not send marketing texts.
  • Frequency. Message frequency varies depending on how often you sign in and play. If you have any questions about your text or data plan, it is best to contact your wireless provider.
  • Cost. Message and data rates may apply, depending on your mobile plan and carrier.
  • How to opt out (cancel). You can cancel Sonye text messages at any time by replying STOP to any message we send you. After you reply STOP, we will send one message to confirm that you have been unsubscribed, and after that you will not receive any further texts from us. If you later want to receive messages again, simply sign in to Sonye as you did before, and messages will resume.
  • Help. For help with our text messages, reply HELP to any message, or contact us directly at ezikebuka1@gmail.com or (832) 660-7508.
  • Effect of opting out. Because Sonye signs you in by text message, opting out means you will not receive login codes or attendance confirmations, which may prevent you from using the Service.
  • Carriers and delivery. Message delivery depends on your wireless carrier and network and is not guaranteed. Carriers are not liable for delayed or undelivered messages, and neither Sonye nor any carrier guarantees that messages will be delivered or delivered on time.

5. The lobby wall

Once you join a game, you can coordinate with the other joined players on that game's lobby wall, using short messages and quick status taps (such as "I'm here" or "running late"). The wall is visible to the other joined players and to the game's organizer. Waitlisted players cannot see or post to it. The wall is shown while the game is live and for a short time after it ends, and messages there are not private.

You are responsible for what you post, and you agree to keep your posts relevant to coordinating the game. You will not post anything that:

  • harasses, threatens, bullies, or abuses anyone;
  • is hateful, obscene, or otherwise offensive;
  • is spam, advertising, or promotional;
  • shares another person's private information; or
  • is unlawful or infringes anyone's rights.

A game's organizer can remove a message from its wall, and Sonye may remove content and suspend or terminate accounts that break these rules. We are not responsible for, and do not endorse, messages posted by users. To report a message or another user, contact us at ezikebuka1@gmail.com.

6. Your conduct

You agree to provide accurate information, to use Sonye only for its intended purpose, and to treat other players with respect. You agree not to misuse the Service, interfere with its operation, attempt to access it in unauthorized ways, or use it to break the law.

7. Games, venues, and assumption of risk

Pickleball is a physical activity that carries inherent risks, including the risk of injury. Games take place at public courts that Sonye does not own or control. Sonye does not supervise games, does not vet or guarantee the safety of any court or venue, and does not vet, screen, or guarantee any other player. You are responsible for your own health, safety, and conduct, and for deciding whether any game, venue, or group is appropriate for you.

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, YOU EXPRESSLY ASSUME ALL RISKS RELATED TO YOUR PARTICIPATION IN ANY GAME AND YOUR USE OF THE SERVICE. YOU HEREBY RELEASE, WAIVE, AND DISCHARGE SONYE AND ITS OPERATOR FROM ANY AND ALL LIABILITY, CLAIMS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY INJURY, DAMAGE, OR LOSS SUSTAINED IN CONNECTION WITH THE SERVICE OR ANY GAME, INCLUDING CLAIMS ARISING FROM THE ACTIVE OR PASSIVE NEGLIGENCE OF SONYE OR ITS OPERATOR. THIS RELEASE DOES NOT APPLY TO ANY LIABILITY THAT CANNOT BE WAIVED OR RELEASED UNDER APPLICABLE LAW.

8. Interactions with other users

Sonye helps strangers form groups to play. We are not responsible for the conduct of any user, online or in person, and we do not screen users. Use good judgment and ordinary caution when meeting and interacting with people you do not know.

9. Service provided "as is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that any slot will fill, that any game will happen, that the Service will be uninterrupted or error-free, or that messages will be delivered.

10. Limitation of liability

EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (SUCH AS LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT), AND TO THE FULLEST EXTENT PERMITTED BY LAW, SONYE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, YOUR PARTICIPATION IN ANY GAME, YOUR INTERACTIONS WITH OTHER USERS, OR ANY VENUE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Sonye and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your conduct during any game, or your violation of any rights of another person.

12. Dispute resolution; arbitration and class-action waiver

Please read this section carefully — it affects how disputes between you and Sonye are resolved. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in the State of Texas, rather than in court. YOU AND SONYE WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. You may opt out of this arbitration agreement by sending us written notice at the contact address below within 30 days of first accepting these Terms. This section does not prevent either you or Sonye from bringing a qualifying claim in small-claims court.

13. Suspension and termination

We may suspend or terminate your access to Sonye at any time, with or without notice, if you violate these Terms or misuse the Service. You may stop using Sonye at any time, and you may request deletion of your account as described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If we make material changes, we will take reasonable steps to let you know. Your continued use of Sonye after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Subject to the arbitration agreement in Section 12, any dispute that proceeds in court will be subject to the courts located in the State of Texas.
